JTKSM through the Employees’ Minimum Standards of Housing, Accommodations dan Amenities Act 1990 (Act 446) enforces the requirements and regulations that must be followed by employers when providing housing, accommodation and facilities for employees.

What is the main requirement that must be complied with regarding the provision of worker accommodation?

All accommodations provided to workers must obtain a Certificate of Accommodation from the Director General of Labour.

Why must agents who place non-citizen (foreign) workers obtain an APS license?

The APS (Private Employment Agency) license was introduced to regulate the placement of non-citizen (foreign) workers. Therefore, any agent not licensed under this Act is not allowed to carry out the placement of foreign workers with any employer.

This measure helps to:

  • Prevent the oversupply of foreign workers without actual employers

  • Avoid exploitation

  • Combat human trafficking

Only APS license holders with Category C are permitted to place foreign workers with employers throughout Malaysia.

What are the consequences if employers and centralized accommodation providers operate without a Certificate of Accommodation?
  • Employers can be fined up to RM50,000.

  • Centralized accommodation providers can be fined up to RM50,000, or face imprisonment of up to 1 year, or both.

What facilities must be provided to workers in accommodations and centralized accommodations?

Employers and centralized accommodation providers must provide facilities as specified under the Minimum Standards of Housing, Accommodations and Employee Amenities (Accommodations and Centralized Accommodations) Regulations 2020.

Can employers charge workers for accommodation?

Yes, employers may charge a rental fee for accommodation not exceeding RM100 per month or any amount agreed upon in the contract of service. The charges can be deducted from the worker’s salary.

However, employers cannot impose any rent or accommodation charges if the contract of service specifies that the accommodation is to be provided free of charge.
